Terms & Conditions

1. Introduction

These terms and conditions (“Terms”) govern your access to and use of the StartGiving platform, including all websites, embeddable widgets, and related services. By using StartGiving you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old to make a donation or create an account. By using the platform you represent that you meet this requirement.

3. Donations

  • All donations are voluntary and made at your own discretion.
  • Donations are processed securely by Stripe. StartGiving does not store your full payment card details.
  • Once a donation is confirmed, it is generally non-refundable unless otherwise stated in our Refund Policy.
  • Recurring donations can be cancelled at any time before the next scheduled payment date.

4. Gift Aid

If you are a UK taxpayer and choose to apply Gift Aid, you confirm that you have paid sufficient Income Tax and/or Capital Gains Tax to cover the amount that all charities and Community Amateur Sports Clubs will reclaim on your donations in the relevant tax year. StartGiving facilitates Gift Aid claims on behalf of charity partners but does not provide tax advice.

5. Accounts

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to provide accurate and complete information when creating an account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

6. Charity Partners (Tenants)

StartGiving provides a platform for registered charity partners to create campaigns, projects, and fundraisers. We verify partner organisations but are not responsible for the use of funds once transferred to a charity. Concerns about a specific charity should be raised through our complaints procedure.

7. Fundraisers

Individual fundraisers created on the platform must be in support of a registered charity partner. StartGiving reserves the right to remove any fundraiser that is misleading, fraudulent, or in breach of these Terms.

8. Prohibited Conduct

You agree not to:

  • Use the platform for any unlawful purpose.
  • Submit false or misleading information.
  • Attempt to gain unauthorised access to any part of the platform.
  • Interfere with the operation or security of the platform.
  • Scrape, harvest, or collect data from the platform without permission.

9. Intellectual Property

All content, branding, and software on the platform is owned by StartGiving or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, StartGiving shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability in relation to any donation shall not exceed the amount of that donation.

11. Modifications

We reserve the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
